民意在现今的审判活动中,扮演着不可忽视的角色。但民间的形成受诸多因素的影响,如伦理道德、舆论引导和专家意见等。刑事审判中必须考虑到民意中的合理因素,但在民意话语与司法话语相互角力的情况下,司法应当牢牢掌握话语权。更重要的是司法要通过审判活动,引导民意,培养民众对法律的信仰。
Public opinion plays an indispensable role in today’s judicial activities. However, the formation of civil society is affected by many factors, such as ethics, public opinion guidance and expert opinions. The criminal justice must take into account the reasonable elements of public opinion. However, judging from the opinion polls and judicial discourses, the judiciary should firmly hold the right of speech. More importantly, the judiciary should pass the trial activities, guide public opinion and cultivate people’s belief in the law.
