食品安全问题已成为当下社会热议的焦点问题,引起了社会的极大关注和高层的关切,对食品安全领域的治理也成为了各级政府、行政执法监管机关和司法机关工作的重点。尽管我国的食品安全法律制度体系还存在着不少问题,行政监管模式和职责划分也有诸多不足,但在现行法律制度框架下,政府行政监管机关、司法机关能够积极履行职责,形成齐抓共管、综合治理的格局,问题是可以得到有效解决的。检察机关作为国家法律监督机关和重要的刑事司法机关,从服务大局、参与社会管理创新角度,从刑法治理入手,可以大有作为。
