“夫妻忠诚协议”是一个在法律实践中非常有争议的问题,本文从协议的具体内容出发,结合《婚姻法》《合同法》的相关规定,将之划归为道义赠与合同相关规定予以调整,并且提出以公证的形式规范实际签订的夫妻忠诚协议的用语的角度来加强协议的效力,以更好的解决实际纠纷。诚信社会,道德要借助于法律。人格权要借助财产措施保护。事实上这类属于道德义务性质的赠与财产合同,应可适用《合同法》第186条。可用司法解释明确这一点,保障我国公民的“承诺是金”和切实建立诚信社会。
