基于军人的特殊使命和保护公共利益的需要,军人权益受到严于普通公民的限制是必要的。但军人是“穿着军服的公民”的法律地位定位,军人权益的有效救济决定了军人权益限制之限制的必要性。本文基于军人权益限制之限制必要性的分析,在基础理论层面上阐述了军人权益限制必须遵循的原则,进而尝试提出构筑军人权益限制之限制的制度设想。
Based on the special mission of the military and the need to protect the public interest, it is necessary for the military rights and interests to be subject to strict restrictions on ordinary citizens. However, the military is the legal status of “citizens wearing military uniforms ”, and the effective relief of military personnel ’s rights determines the necessity of restriction on the rights and interests of military personnel. Based on the analysis of the necessity of restriction on the limitation of military rights and interests, this paper expounds the principle that must be followed in the limitation of rights and interests of military personnel on the basic theory level, and tries to put forward the system assumption of the limitation of military rights and interests.
