本文从概述被害人权利保护的意义和国内外被害人权利保护的立法情况入手,简要说明联合国大会及有关国家加强和发展被害人权利保护的立法和实践情况;分析我国刑事立法在公诉案件被害人权利保护方面存在的缺陷及被害人国家补偿制度的缺失对被害人权利保护的不彻底性;进而提出完善被害人权利保护制度的建议和立法设想。
This article starts with an overview of the significance of protecting victims ’rights and the protection of victims’ rights both at home and abroad. It outlines the legislation and practice of the UN General Assembly and relevant countries in strengthening and developing the protection of victims ’rights. It also analyzes the existence of criminal legislation in the protection of victims’ rights in public prosecution cases And the incompleteness of victim’s rights protection in the absence of the national compensation system for victims; and then puts forward suggestions and legislative ideas on how to perfect the system of protecting victims’ rights.
