本文分析了业界对标准专利问题争议的焦点,并分析了目前我国对标准专利问题进行规制的相关法规制定情况,包括:国家标准化管理委员会和国家知识产权局共同发布的《国家标准涉及专利的管理规定(暂行)》、国家工商行政管理总局发布的《关于禁止滥用知识产权排除、限制竞争行为的规定》和最高人民法院的《关于审理侵犯专利权纠纷案件应用法律若干问题的解释(二)》;还有一些正在制定中的法规,如:国家知识产权局《中华人民共和国专利法修订草案(送审稿)》的征求意见稿、国家发展改革委《关于滥用知识产权的反垄断指南》的征求意见稿和工商总局《关于滥用知识产权的反垄断执法指南(国家工商总局第七稿)》的征求意见稿,分析了这些法规对规制标准专利问题发挥的作用,以及各自可能存在的问题;并指出为了更加合理规范地处理标准专利问题,应在突出各项法规针对性的同时,还要加强它们之间的协调统一。
This article analyzes the industry’s focus on the issue of standard patents, and analyzes the current situation of China’s regulation of the standard patent issues related to the formulation of laws and regulations, including: the State Standardization Administration and the State Intellectual Property Office jointly issued the “national standards involving patent management Provisions (Provisional) ”, the“ Provisions on the Prohibition of Abusing Intellectual Property Rights and Restrictions on Competition ”promulgated by the State Administration for Industry and Commerce and the Interpretation of the Supreme People’s Court on Several Issues Concerning the Application of Law in the Trial of Cases of Infringement on Patent Disputes (2) ; And some laws and regulations under enactment, such as the Draft for Opinion on Revising the Patent Law of the People’s Republic of China (Draft for Review) issued by the State Intellectual Property Office, the “Anti-monopoly Guide on Abuse of Intellectual Property Rights” of the National Development and Reform Commission Draft of the Opinion and SAICM Guidelines on Antitrust Enforcement of Intellectual Property Abuse (SAICO Seventh Draft), analyzing the role of these laws and regulations in regulating standard patent issues and their respective possible problems; And pointed out that in order to deal with standard patent more reasonably and properly, In highlighting various laws and regulations targeted at the same time, we must also strengthen coherence between them.
