按语:2013年9月9日,最高人民法院召开新闻发布会,发布《最高人民法院、最高人民检察院关于办理利用信息网络实施诽谤等刑事案件适用法律若干问题的解释》(下简称《司法解释》)。这部总共10条的《司法解释》,通过厘清信息网络发表言论的法律边界,明确7种情形适用公诉程序,为惩治利用网络实施诽谤等犯罪提供了明确的法律标尺,从而规范网络秩序、保护人民群众合法权益。《司法解释》于2013年9月10日起施行。
Key words: On September 9, 2013, the Supreme People’s Court held a press conference and released the Interpretation on Several Issues Concerning the Application of Law in Handling Criminal Cases of Use of Information Networks such as Defamation by the Supreme People’s Court and the Supreme People’s Procuratorate (hereinafter referred to as “judicial interpretation” ). This total of 10 “judicial interpretations” clarifies the application of public prosecution procedures in seven cases by clarifying the legal boundaries of the speech made by the information network and provides a clear legal measure for punishing the use of the Internet to carry out defamation crimes so as to standardize the network order and protect Legitimate Rights and Interests of the People. Judicial Interpretations came into effect on September 10, 2013.
