在学界,对家庭承包方式的土地承包经营权主体问题存在一定的分歧,在司法实践领域,法官们则意见比较统一,认为土地承包经营权的主体是农户,而不是农民。通过对文义解释等解释方法的运用,笔者认为家庭承包方式的土地承包经营权的主体只能是农民个人而不是农户,农民个人享有完整的土地承包经营权利。
In academia, there are some differences in the subject of the land contractual management right of family contracting methods. In the field of judicial practice, the judges have more unified opinions, and think that the main body of contractual management right of land is the farmer, not the farmer. Through the application of the interpretation methods such as the textual interpretation, the author believes that the main body of the land contractual management right of the household contractual way can only be the peasant individual rather than the peasant household, and the individual peasant enjoys the complete right of land contractual management.
