伴随着知识经济和信息时代的到来,商业秘密在全球化市场经济运行中逐渐凸现其稀缺资源的优势,也常常成为不法行为人觊觎的目标。其中,单位侵犯商业秘密的犯罪行为尤其典型。本文以商业秘密犯罪与单位犯罪的融合为基点,明确了侵犯商业秘密单位犯罪的立法含义。在价值层面分析了侵犯商业秘密单位犯罪价值取向的偏差和矫正,在法律规范层面阐述了侵犯商业秘密单位犯罪的立法缺陷和完善。
With the advent of the knowledge economy and the information age, trade secrets gradually highlight the advantages of their scarce resources in the operation of the global market economy and often become the target of criminals. Among them, the crime of violating trade secrets by the units is particularly typical. This article takes the merging of commercial secret crime and unit crime as the starting point, and clarifies the legislative implication of the crime of infringing trade secret units. In the aspect of value, the author analyzes the deviation and rectification of the criminal value orientation of the commercial secret units and expounds the legislative defects and perfection of the crime of violating commercial secret units at the legal norm level.
