近年来,突发性犯罪不断出现,从已发生的突发性犯罪来看,突发性伤害犯罪是其中特殊又常见的一种犯罪类型,且最具典型代表的便是动辄行凶捅刀子,常会造成受害人伤害或死亡的结果。这种行为的定性关键取决于行为人对受害人伤害、死亡结果在主观上持什么样的心理态度。刑法理论界对捅刀子案件中行为人的主观罪过主要存在两种观点,一种观点认为行为人的主观罪过是间接故意,另一种观点则认为是直接故意。本文以突发性犯罪为切入点,从实际伤害结果出发,提出了新的观点,即造成伤害结果的为直接故意,造成死亡结果的为间接故意。
