我国传统的法学教育与大陆法系趋同,主要采用课堂讲授的方式,重视系统传授法学理论知识。实践性教学方法的缺失使法科生缺乏司法实践能力。如何在培养学生的司法实践能力方面有所突破一直是法学教学的瓶颈。在法学专业各种实践性教学方法中,模拟法庭教学方法有着独特的优势。笔者所任教的学校在《2016年中国大学评价研究报告》中排名广东省民办大学第一名。关于模拟法庭教学方法在独立学院教学中如何运用的探讨,将在同类院校中起着积极的示范作用。
The traditional law education in our country converges with that of the civil law system mainly in the form of classroom teaching and attaches importance to systematical teaching of legal theoretical knowledge. The lack of practical teaching method makes law students lack of judicial practice ability. How to make a breakthrough in cultivating students’ ability of judicial practice has always been the bottleneck of law teaching. Among the various practical teaching methods in law major, mock court teaching method has unique advantages. The school I teach is ranked first in Guangdong Province Private University in the 2016 China University Evaluation Research Report. The discussion on how to use moot court teaching methods in independent college teaching will play an active exemplary role in similar colleges and universities.
