俄罗斯刑罚阶梯制度最早起源于帝俄时代,后几经历史变迁形成了当今俄罗斯联邦刑事立法中所规定的阶次分明、科学合理的刑罚阶梯制度体系。近年来,俄罗斯立法者在其刑罚体系的合理化进程当中,剔除了那些已经丧失社会现实意义的刑种,逐步完善现有刑罚制度并引入新的刑罚种类。俄立法机关在其刑罚的分阶与类型化过程中,逐步深化刑事政策原则和刑法原则的贯彻与融入,进一步加强现有刑罚阶梯制度体系的构建基础。俄罗斯联邦现行刑罚制度呈现出人道化、轻刑化、自由化与替代刑适度扩张的发展趋势。
The system of the penalty ladder in Russia originated from the era of imperial Russia and Russia. After several historical changes, the system of the ladder of punishments of the order of the law in the present-day Russian Federation has been established. In recent years, Russian legislators have eliminated the penalties that have lost their social significance in the rationalization of their penal systems, gradually perfected the existing penal system and introduced new kinds of penalties.
