刑事诉讼制度下的人权保障在无罪推定原则中可见一斑,这一原则作为保障犯罪嫌疑人、被告人人权的重要手段,已然成为国际通行的刑事诉讼法基本原则,在人权保障方面发挥了重大作用。本文从人权保障的视角出发,首先阐述了人权保障在无罪推定原则中的体现,简述了无罪推定是如何起到人权保障作用的;其次对无罪推定原则的内涵进行分析,指出了三个方面的具体内容;再次结合我国实际情况,探讨了立法,司法实践和法律意识三方面的不足;最后基于存在的问题和现实的需要,提出构建我国无罪推定原则的个人思考。
The principle of human rights protection under the system of criminal procedure is evident in the principle of presumption of innocence. This principle, as an important means of safeguarding the human rights of criminal suspects and accused, has become the internationally accepted basic principle of criminal procedure law and has played an important role in safeguarding human rights effect. From the perspective of human rights protection, this article first expounds the embodiment of human rights protection in the principle of presumption of innocence, briefly describes how the presumption of innocence plays the role of human rights protection, and secondly, analyzes the connotation of the principle of presumption of innocence, Three aspects of the specific content; once again with the actual situation in our country, explores the legislative, judicial practice and legal awareness of the three aspects of the deficiencies; and finally based on the existing problems and practical needs, put forward to build our country’s principle of innocence presumption of personal thinking.
