近年来,随着我国劳动力的匮乏,企业用工慌现象的出现,农村闲置劳动力进城务工的普遍性,涉及农民工劳动保障尤其是超过退休年龄的城市务工者,在他们为社会做出贡献的同时,也面临着尴尬处境,最明显的就是,出现因公伤残,是否可以享受工伤待遇的问题,本文将着重在现有的立法的框架内进行粗浅的分析。
