本文认为两种环境保护模式即市场经济模式、政府管制模式不是相互对立而是相辅相成的。两种模式各有优势,在环保立法和实践中应该把两者有机地结合起来。作者探讨了在香港这个市场经济下的社会环境保护是如何进行的,特别是空气污染的防治。在此基础上,分析了中国环境立法的现状并与香港相比较,从而评价中国环境立法的得与失。
This paper argues that the two modes of environmental protection are the market economy mode and the government control mode are not mutually antagonistic but complement each other. Each of the two modes has advantages and should be organically integrated in environmental legislation and practice. The author explores how social environmental protection in Hong Kong, a market economy, is carried out, especially in the prevention and control of air pollution. On this basis, the current situation of environmental legislation in China is analyzed and compared with that of Hong Kong so as to evaluate the gains and losses of China’s environmental legislation.
