引渡是指一国把在该国境内而被他国追捕、通缉或判刑的人,根据有关国家的请求移交给请求国审判或处罚。有权请求引渡的国家是:(1)罪犯本人所属国;(2)犯罪行为发生地所在国;(3)受害国。引渡是属于一个国家主权范围自由决定的事。按国际法规定,国家并无引渡罪犯的义务。但如果国家间有条约规定,应履行条约义务。如无条约规定,是否向他国引渡,则完全由被请求国自行决定。如果发生几个国家同
Extradition refers to the transfer by a State to a requesting State of trial or punishment at the request of the country concerned, if it has been pursued, wanted or sentenced by another country within its territory. Countries that have the right to request extradition are: (1) the country to which the criminal belongs; (2) the country where the criminal act took place; and (3) the injured State. Extradition is a matter that is freely determinable by the sovereignty of a nation. According to international law, the state has no obligation to extradite criminals.
