新刑诉法中针对未成年犯罪嫌疑人的诉讼权利和其他合法权利,设置了附条件不起诉制度,如果未成年犯罪嫌疑人在检察机关规定的考察期内履行相应的法定义务,则检察机关可以根据实际情况,对其作出不起诉处理。附条件不起诉制度在适用中对公诉机关产生了很大的挑战,需要我们不断的完善。
