2000年最高人民法院关于网络著作权纠纷案件适用法律的司法解释将网络环境下的侵权管辖进行了区别于《民事诉讼法》的规定,这使我国网络著作权侵权案件的管辖规则变得更针对性与可操作性。然而,通过对“大长今”诉百度一案中管辖权争议的分析,可以发现这项旨在提高诉讼效率的管辖规则仍然可以通过诉讼技巧而被规避,进而成为当事人滥诉的基础。
The judicial interpretation of the applicable law of the Supreme People’s Court in 2000 on the case of online copyright disputes distinguishes the jurisdiction of infringement under the network environment from that of the Code of Civil Procedure, which makes the rules governing the infringement of copyright on the Internet in China more specific and relevant Operability. However, the analysis of jurisdictional disputes in Ba Dadong’s case shows that the jurisdictional rules aimed at improving the efficiency of litigation can still be circumvented by litigation skills and thus become the basis of litigation .
