在体育犯罪严重的当代社会中,文章通过运用古典犯罪学派、实证犯罪学派、马克思主义学派、控制平衡犯罪理论等等流派阐述了犯罪产生的理论依据,以此推论出体育犯罪产生的主要理论依据。最终利用卢梭和孟德斯鸠等的观点来辨析体育犯罪的起源,主要分析了人类攻击性与自然的关系、运动的攻击性与体育犯罪的关系、越轨行为与法律公民自由的关系、越轨行为与体育犯罪关系,提出了体育犯罪起源于人类自然不平等和法律与公民自由关系的出现,为体育犯罪研究奠定了良好的基础。
In the modern society where sports crime is serious, the article elaborates the theoretical basis of crime by using the schools of classical criminology, empirical criminology, Marxist school and balance control crime theory, so as to deduce the main theoretical basis of sports crime . Finally, it analyzes the origin of sports crime from the perspectives of Rousseau and Montesquieu. It mainly analyzes the relationship between human aggression and nature, the relationship between sport aggression and sports crime, the relationship between deviant behavior and legal civil liberties, The relationship between sport crime and sport crime is put forward. The origin of sport crime originated from the natural inequality of mankind and the relationship between law and civil liberties, which lays a good foundation for the study of sport crime.
