我国知识产权保护工作还面临许多困难和问题,国内企业与个人知识产权意识不足,知识产权立法存在滞后与空白,知识产权执法也很薄弱。因此,要完善知识产权的宪法保护,要完善知识产权实体法和程序法,并用反不正当竞争法对知识产权进行附加的补充保护。
There are still many difficulties and problems in the protection of intellectual property rights in our country. The awareness of intellectual property in domestic enterprises and individuals is not enough. There are lags and gaps in the legislation of intellectual property and the enforcement of intellectual property rights is also very weak. Therefore, in order to perfect the constitutional protection of intellectual property, it is necessary to improve substantive law and procedural law of intellectual property and supplement additional protection of intellectual property by using unfair competition law.
