社区矫正制度虽然已经载入刑法典和在实践中实施了好几年,但实践效果并不能让各方面满意。针对实践中出现的显著问题,有关方面并没有给予足够的重视,致使一些致使短暂性的问题和难处影响了对五种人的矫正工作。本文认为应该正视实践中存在的问题,在司法行政部门现阶段无法单独管理的情况下,采取过渡时期的两部门的共同管理,最后在地方政府的协调整合之下,采用系统的安排对社区矫正制度进行必要的改革,从而克服执行矫正工作的人员的不利思想,最终真正发挥社区矫正制度的生命力。
Although the community correction system has been incorporated into the Penal Code and implemented in practice for several years, its practical effect can not satisfy all parties concerned. In view of the significant problems that have arisen in practice, the relevant parties have failed to pay enough attention to them. Some of the problems and difficulties that have caused temporary problems have affected the rectification of the five kinds of people. This paper holds that we should face up to the problems in practice and adopt the joint management of the two departments during the transitional period when the judicial administrative department can not be managed independently at the present stage. Finally, under the coordination and integration of local governments, System to carry out the necessary reforms so as to overcome the unfavorable thinking of the personnel who carry out rectification work and finally to really bring into play the vitality of the community correction system.
