Many concepts that form the basis of competition policy are also the theoretical basis for establishing legal norms. This article aims to give a brief introduction to the mainstream theories in this field, in which competition becomes a political, legal and economic variable. R. Bork argues: “Antitrust policies may be justified only if we can answer positively the question of what the law means or what the legislative objectives are.” E. Fox called it “ The controversy over the nature of antitrust ”continues. This essay starts with the analysis of the theoretical premises of the concept of competition and reviews the arguments of the Chicago School and the EU respectively.
