我国现行行政强制执行存在的主要问题是行政机关行政强制执行难,法院行政执行负担过重使审判受到影响,行政强制执行程序缺乏规范等。行政强制执行手段的强制性使其天生具有侵益性特征,如何既保证行政强制执行权的有效行使,使其维护公共秩序与服务公共利益的作用得到完美发挥,又保障行政相对人的合法权利和受法律保护的利益不会遭受它的侵害。本文从行政强制执行程序的现状分析,提出完善现行制度的解决方案。
The main problems existing in the current administrative enforcement of our country are the administrative enforcement difficulties of administrative organs, the overburdened administrative execution of courts, the imposition of judicial procedures and the lack of standardization of administrative enforcement procedures.
