对于采行政执法中心制的我国反垄断法实施而言,相关执法决定的司法审查强度问题关乎反垄断实体规则的塑造及最终的有效实施,迫切需要关注。然而,我国现行立法及实践并不足以对此问题提供支撑。作为世界上最先进的反垄断司法辖区,美国经验可资借鉴。从现行审查强度来看,联邦巡回上诉法院对FTC的事实认定进行较为遵从的实质性证据审查,对法律解释和具体的法律适用重新审查,但对后者给予一定遵从,对裁量适用滥用裁量权审查。这根植于美国事实-法律二分法的上诉审传统,但同时呈现出一定的特殊性。而从纵向历史维度,对FTC执法决定的司法审查强度则由于美国联邦反托拉斯法实施的司法中心制和FTC的机构声誉等因素呈现出动态变化的过程。
As to the implementation of antitrust law of our country which adopts administrative law enforcement center, the issue of the intensity of judicial review of the relevant law enforcement decisions concerns the shaping of the antitrust entity rule and its ultimate effective implementation, and there is an urgent need of concern. However, the current legislation and practice in our country are not enough to support this issue. As the world’s most advanced antitrust jurisdiction, the United States can learn from experience. Judging from the intensity of the current review, the Federal Circuit Court of Appeals reviewed the substantive evidence of FTC’s factual compliance more closely, reviewed the legal interpretation and specific legal application, but gave some compliance to the latter and applied the discretionary power to discretion Review. This rooted in the appellate tradition of American fact - dichotomy of law, but at the same time it shows some particularities. However, judging from the longitudinal historical dimension, the strength of judicial review of FTC’s law enforcement decisions shows a dynamic process due to the judicial center system implemented by the U.S. federal antitrust law and the FTC’s institutional reputation.
