实现刑法现代化的关键首先在于实现刑法理念的现代化,我国目前应该树立权利本位刑法观、坚守刑事法治、保持刑法谦抑。结合目前刑法运行的实践,这三个理念应该取得符合现代刑法运行实践的合理内涵。
The key to the modernization of criminal law lies in the modernization of the concept of criminal law. At present, our country should establish the concept of right-based criminal law, stick to the criminal law and keep the criminal law modest. Combined with the current practice of criminal law, these three concepts should be made to meet the reasonable connotation of the operation of modern criminal law.
