一、背景1989年3月2日国务院颁布的《民用航空运输不定期飞行管理暂行规定》(国务院第29号令),对外国航空运输企业在外国与我国间从事运送旅客、行李、货物和邮件的不定期飞行作出了原则性规定。该暂行规定第4条明确要求:“从事不定期飞行,必须向中国民用航空局申请,经批准后方可飞行。申请和批准程序由中国民用航空局制定。”据此,民航总局于1990年11月23日以中国民用航空总局第14号令的形式发布了现行的《外国民用航空运输不定期飞行管理细
