仲裁财产保全程序的完整构造应包括仲裁财产保全裁定程序和财产保全执行程序双重结构,以此为理论基点反思我国仲裁财产保全裁定程序,应当借鉴域外有益经验建立并存模式合理配置我国仲裁财产保全裁定权,并相应完善仲裁财产保全裁定程序,确立当事人直接申请财产保全原则,赋予当事人财产保全裁定异议权,衔接财产保全裁定程序和保全执行程序。
