社会经济发展促进法治社会进程的加快,确保人们生命财产等权利。其中民法原则与民法规则两者之间概念不同,但彼此存在包含关系,其中民法原则是民法规则的起源与根本。民法原则要比民法规则有着更广的适用范围,并完善民法规则中存在问题,可以直接作为法官仲裁个案的依据。基于此,本文中重点阐述民法原则与民法规则之间的关系。
Social and economic development to speed up the process of the rule of law in society, to ensure people’s life and property and other rights. Among them, the concepts of civil law and civil law are different, but they contain the relationship of each other. The principle of civil law is the origin and basic of civil law rules. The principle of civil law has a wider scope of application than the rules of civil law and perfects the problems existing in the rules of civil law and can directly serve as the basis for the judge’s arbitration case. Based on this, this article focuses on the relationship between the principles of civil law and the rules of civil law.
