理论界对“双边市场”概念研究的匮乏是导致“双边市场”存在误用和滥用的倾向并引发一系列反垄断分析问题的重要原因,因此需要在全面梳理“双边市场”概念、特征的基础上总结其判定依据,以正本清源。尽管学界对“双边市场”的概念莫衷一是,但其本质特征是需解决鸡蛋相生问题、交叉网络外部性和价格结构非中立性。因此,存在交叉网络外部性、科斯定理失效及价格结构的非中立性是判定双边市场的主要依据。在具体判定过程中,应采用定性与定量相结合的方法,重点考查平台两边用户间交叉网络外部性的存在性及其重要性以及它们之间是否存在转移。
The lack of theoretical research on the concept of “bilateral market” is an important reason leading to the misuse and abuse of “bilateral markets” and triggering a series of antitrust analysis problems. Therefore, it is necessary to comprehensively sort out the “bilateral market ”Concept, characteristics based on the basis of its judgment, with the original Qingyuan. Although the concept of “bilateral market ” is not the same in academia, its essential feature is to solve the problem of egg compatibility, cross-network externality and price structure non-neutrality. Therefore, the non-neutrality of cross-network externality, Coase theorem failure and price structure is the main basis for judging the bilateral market. In the process of concrete judgment, a combination of qualitative and quantitative methods should be adopted to focus on the existence and importance of cross-network externality between users on both sides of the platform and whether there is any transfer between them.
