公诉变更制度是现代公诉制度的重要内容,对实体真实的切实追求和对诉讼效率及权利保障的适当兼顾,构成了该制度的正当化基础。而我国的公诉变更制度过多地侧重于对实体真实的追求,忽视了诉讼效率,尤其是被告人合法权利的保障。我国刑事诉讼法应对公诉变更制度作明确规定,通过完善相关法律制度,以促进公诉变更的正当化运作。
The system of public prosecution change is an important part of the modern prosecutorial system. The actual and practical pursuit of the entity and proper consideration of the efficiency and rights protection of litigation constitute the justification foundation of the system. In our country, the system of public prosecution changes too much emphasis on the real pursuit of the entity, ignoring the efficiency of litigation, especially the defendant’s legal rights protection. The criminal procedure law of our country should make clear stipulations on the system of change of public prosecution. Through improving the relevant legal system, we should promote the legalized operation of the change of public prosecution.
