立法解释规定,黑社会性质组织的成立需要具备四个条件:一是组织特征;二是行为特征;三是经济实力特征;四是控制特征。黑社会性质组织的认定需要同时具备这四个条件,缺一不可。黑社会性质组织与司法实践中经常提到的恶势力和犯罪集团的界限在某些情况下容易混淆,黑社会性质组织与犯罪集团是严格的刑法概念,而恶势力则不是刑法概念,明确他们之间的界限有利于准确认定黑社会性质组织犯罪。
Legislative interpretation of the provisions of the establishment of triad nature need to have four conditions: First, the organizational characteristics; second is the behavior characteristics; third is the economic strength of the characteristics; Fourth, the control characteristics. Identification of triad nature organizations need to have these four conditions, are indispensable. In some cases, the boundary between the evil forces and criminal groups often mentioned in the criminal syndicate’s organization and judicial practice is easily confused. The criminal syndicate and criminal syndicates are strictly criminal law concepts, while the evil forces are not the concept of criminal law. The boundaries are conducive to accurately identify triad criminal organizations.
