精神损害赔偿作为对受害人的补偿手段有其适用的条件,其客体应主要是一定的人身利益,由人身而导致的精神损害,其包含了人们的特定情感,故当其遭受损害时应得到法律的精心呵护,获得相应的补偿,但精神损害赔偿的适用并不能无条件地全盘适用,在符合特定条件时才具有其适用的余地。因此,文章通过研究精神损害赔偿的适用范围以明确它在不同情形下的具体适用。
