目的犯的实质化——以目的与故意的关系为中心

一、问题的提出长期以来,我国刑法理论在目的犯这个问题上热衷于讨论所谓的目的说和动机说,并为此投入了大量的学术资源。[1]有学者认为动机说与目的说在刑法具体问题的处理上没有什么不同,因此对此加以区分就很难说有现实意义。[2]也有学者认为这种讨论源自于对外国刑法学的片面理解和主观主义的影响,并主张以直接故意意志因素和意志以外的目的或断绝结果犯和短缩二行为犯替代之。[3]
