一、序论本文尝试对于行政过程中“参加”与“责任”及相关概念进行考察。本文在第二部分中指出,“参加”是介于“决定”与“信息交流”之间、且不具备明确轮廓的一个概念。第三部分以说明责任(accountability)为中心对“责任”概念进行考察,特别是以信息公开制度和文书管理制度作为切入点探究信息的产生过程,并就信息与“责任”之间的关系进行探讨。第四部分则试图跳出“责任”概念所必然包含的单向性特质,并进而对“参加”概念的定位及其界限进行探讨。
I. Introduction This article attempts to examine the concepts of “participation” and “responsibility” in the administrative process and related concepts. The second part of this paper points out that “participation ” is a concept between “decision ” and “information exchange ”, and does not have a clear outline. The third part examines the concept of “responsibility” with the accountability as the center, and explores the generation process of information with the open system of information and the system of document management as the starting point.
