近年来,与国家对经济犯罪打击力度不断加大、适用死刑越来越频繁相对应的是经济犯罪的日益猖獗,这个事实说明在经济犯罪中严刑峻法并不能有效地防止经济犯罪的发生,反而出现了经济犯罪一旦被查处就是大案要案的局面。这就需要我们换一个角度去考虑问题,找到控制经济犯罪的有效途径。基于经济犯罪的经济性极强的特点,法经济学的理论能更好地解释对经济犯罪中死刑适用控制的依据和进行改善的建议。
In recent years, with the continuous crackdown on economic crimes by the state and the application of the death penalty increasingly corresponding to economic crimes, the fact shows that strict penalties in economic crimes can not effectively prevent the occurrence of economic crimes, Instead, once an economic crime is investigated, it is a case of a major case. This requires that we take a different perspective to consider the issue and find an effective way to control economic crimes. Based on the extremely economic features of economic crime, the theory of law and economics can better explain the basis for the application of the death penalty in economic crimes and suggestions for improvement.
