本文应用“四性”综合评价法评价了52宗卫生行政处罚案例,结果执法过程无一宗合格,基本合格率仅占7.69％,完整性和准确性符合率分别为3.85％和5.77％。文书基本合格率仅23.96％,其中,《卫生行政处罚决定书》基本合格率仅23.96％,且“四性”单独评价合格率均在60％以下。提示提高卫生执法水平和质量问题不容忽视。也提示对卫生执法案例的剖析是必要的。
In this paper, 52 cases of sanitation administrative sanctions were evaluated using the “four-character” comprehensive evaluation method. As a result, none of the cases of law enforcement was qualified, with the basic passing rate accounting for only 7.69% and the coincidence rates of completeness and accuracy being 3.85% and 5.77% respectively. The basic passing rate of instruments is only 23.96%, of which, the basic pass rate of “Sanitation Administrative Penalty Decisions” is only 23.96%, and the “four sexes” individually evaluated pass rates are below 60%. Prompted to improve the level of health law enforcement and quality issues can not be ignored. It also suggests that an analysis of health enforcement cases is necessary.
