“培训”已成为人们学习工作中的一个重要组成部分,消费者与培训机构毫不相关,而能把两者联系起来并产生相应法律关系的,只能是培训机构和受培训者双方合意的法律行为,它通常的表现形式是,受培训者和培训机构之间产生以培训服务为内容的培训合同。实践中,培训机构与受培训者之间缔约活动通常可分发布招生信息、受培训者申请报名、培训机构招生录取并发放录取通知书以及受培训者入学报到等阶段,从法律层面研究培训合同的缔约过程并认识各个阶段的行为性质,对规范双方当事人的行为,对促进培训事业的健康发展意义重大。
