反垄断法宽免制度的产生源于成熟的经济学理念,而其有效实施还须有匹配的制度安排。要实现制度效用的最大化,为卡特尔成员举发违法行为提供更为有效的激励,且为卡特尔的形成提供更为有力的阻遏,需要制度结构的层次清晰和适用程序的透明可期。2014年澳大利亚《卡特尔宽免和合作政策》的修订,提供了回顾总结与展望制度演进的最新样本,可以对宽免制度的二元结构、多维层次和分步实施展开结构与功能相结合的细致描述和比较分析,为完善我国反垄断法提供借鉴。
The antitrust exemption system originated from the mature economic philosophy, and its effective implementation must have a matching institutional arrangement.
