为保障劳动者个人及其家庭成员的基本生活,促进社会公平稳定,我国已初步建立最低工资制度。但该制度运行面临着观念障碍、各地执行最低工资标准口径不统一、标准制定机制不健全、标准覆盖率普遍偏低等等难题。笔者建议工资立法以最低基本工资标准替代最低工资标准,坚持实行地方标准的同时,体现行业特点。建立健全三方标准制定机制,保护特殊劳动关系,扩大最低工资标准覆盖率。
In order to guarantee the basic livelihood of workers and their family members and promote social fairness and stability, China has initially established the minimum wage system. However, the operation of the system is confronted with problems such as ideological barriers, inconsistencies in the implementation of minimum wage standards throughout the country, imperfect standard-setting mechanism and generally low standard coverage. The author suggests that the wage legislation substitute the minimum wage with the minimum basic wage, stick to the implementation of local standards and reflect the characteristics of the industry. Establish and improve a tripartite standard setting mechanism to protect special labor relations and increase coverage of the minimum wage.
