原告:张天佑,智力四级残疾人。被告:石家庄天巧造纸厂。原告是智力四级残疾人,1992年3月开始在被告单位(国营企业)做计划外临时工。2000年1月,原告与被告签订了为期一年的劳动合同,期满后又续订了为期五年的劳动合同。在合同履行期间,原告多次因病住院,有证据的住院天数就达411天,加上原告是智力残疾人,不能胜任岗位工作,合同期满后,被告未与原告再续订劳动合同,但也未及时办理合同终止手续,而是安排原告做临时工工作,仍给原告发放合同制工人工资至2006年5月,同年6月开始改发放临时工工资。
