近年来,社会中频发的“南京虐童案”、“黑龙江针扎女婴事件”等恶性事件严重危害到儿童权益,引起了学界强烈谴责与舆论。如何有效地保护遭受家庭暴力儿童的权益受到广泛关注,这也是国家在儿童权益保护立法方面的重要内容。本文旨在通过对我国目前儿童权益保护的相关立法进行分析研究,结合新《反家庭暴力法》的实施,进一步探究儿童权益保护存在的不足及亟需进行的立法完善。
In recent years, such vicious incidents as the “case of child abuse in Nanjing” and the “incident of baby girl in Nanjing” severely endangered children’s rights and interests, have caused the academic community to strongly condemn and public opinion. How to effectively protect the rights and interests of children suffering from domestic violence has drawn wide attention, which is also an important part of the state’s legislation on the protection of children’s rights. The purpose of this paper is to analyze and study the current legislation on the protection of the rights and interests of children in our country and to combine with the implementation of the new Anti-Domestic Violence Law to further explore the deficiencies in the protection of rights and interests of children and the legislative improvements that are urgently needed.
