鉴定结论在我国司法运用中存在很多问题。我国对鉴定结论进行规范与完善 ,首先应设立科学的鉴定制度 ,包括确立鉴定的等级制度、鉴定的终局制度和鉴定的程序规范 ;其次应规范鉴定结论证据效力运作的诉讼制度 ,包括要明确鉴定结论属当事人举证责任 ,规范鉴定结论审查的庭审程序 ,明确对鉴定结论进行审查的实体内容和建立鉴定证据制度有效运作的保障机制。
Appraisal Conclusion There are many problems in the judicial application of our country. In order to standardize and perfect the conclusion of appraisal, our country should first set up a scientific appraisal system, including establishing the appraisal system, appraisal end system and appraisal procedure standard. Secondly, we should standardize the appraisal conclusion, Conclusion is the burden of proof on the part of the parties, regulating the trial procedure for the examination of the conclusions of the appraisals, clarifying the contents of the entity examining the appraisal conclusion and establishing a safeguard mechanism for the effective operation of the appraisal evidence system.
