农民工工伤赔偿请求权具有多重属性。在现行工伤保险制度下,应该允许农民工对工伤事故有选择工伤保险赔偿请求权和侵权行为请求权的权利。本文主张修改现行工伤保险法律制度,构建统一的农民工工伤赔偿请求权救济模式保障农民工的合法权利。
Migrant workers claim for workers' compensation has multiple attributes. Under the current industrial injury insurance system, migrant workers should be allowed to choose the right to compensation for industrial injury insurance and the right to claim infringement upon work injury accidents. This paper advocates the revision of the current legal system of industrial injury insurance and the construction of a unified relief model for workers' compensation claims to guarantee the legal rights of migrant workers.
