合伙人之一要求确认其与合伙企业存在劳动关系,并支付工资报酬、购买社会保险是否可行,当前司法实践对此还没有统一的认定,因此该问题引发了笔者的深思:合伙事务执行人是否必须应该是我国法律规定的合伙人之一?合伙事务执行人与其他合伙人之间是怎样的一个法律关系?合伙事务执行人与合伙企业之间的法律关系该如何界定?等问题。我国《合伙企业法》第26条的规定可以看出,对于合伙事务执行人必须是合伙人之一,如实践中存在非合伙人执行合伙事务情况引发的相关问题并没有相关的处理依据,而合伙人在执行合伙事务中在劳动关系层面的界定,并没有明确的法律依据,也没有统一的法理意见。本文试图从合伙事务执行人与企业间法律关系的各种学说、合伙事务执行人产生、劳动关系的构成要件、合伙事务执行人与企业权利义务主要适用的法律、劳动法与合伙企业法的立法思想等方面进行阐述,力求理清合伙企业事务执行人的产生或合伙事务的执行涉及的法律关系,从而对学理和审判实践有所裨益。

This article attempts to implement the legal relationship between the people and the enterprise from the various aspects of partnership theory, the implementation of partnership affairs, the composition of labor relations requirements, the implementation of partnership affairs and the rights and obligations of enterprises mainly applicable law, labor law and partnership law legislation Ideology and other aspects, trying to sort out the legal relationship involved in the execution of the partnership affairs and the execution of the partnership affairs, so as to benefit the study and trial practice.
