依法治国是一个国家长治久安的必要保障,为了维护国家法律的稳定,刑法要求具有一定的稳定性,即所谓的罪刑法定,以保障法律的权威。但是,随着社会的发展,新的案件形式和新的法律现象即会产生,此时即需要刑法解释,这与罪刑法定会产生一定的冲突,文章从我国的基本国情出发,结合目前国家的社会基本现象和主流问题,具体论述了罪刑法定前提下的刑法解释,以维护法律的权威,促进社会的稳定和繁荣。
