笔者通过实地调查发现,基于减轻家庭生活负担、缓和家庭矛盾或对习俗认同等原因,湖北省团风县长林咀村普遍采用多次性分家的做法。以此为出发点,本文详细地描述了该分家析产模式的整体概貌,并深入探讨了分家所涉及的析产、赡养、未婚弟妹的安排等主要内容。其中,重点论述了分家和析产的关系、可分财产的性质和范围、析产的原则及其可能与实际运作存在冲突等相关问题。此外,本文对分家纠纷的解决也作了简要介绍。
The author found through field surveys that based on the reasons such as alleviating the burden of family life, alleviating family conflicts or approving of custom, the practice of multiple sex separation was widely adopted in Changlinju Village, Tuanfeng County, Hubei Province. Using this as a starting point, this paper describes in detail the overall profile of the separation model and analyzes in depth the main contents of the separation, maintenance and arrangement of unmarried siblings involved in the separation. Among them, the dissertation focuses on the relationship between separation and property analysis, the nature and scope of separable property, the principle of property separation and its possible conflict with the actual operation. In addition, this article also made a brief introduction of the settlement of disputes between different parties.
