自由和财产是洛克追随的两个核心命题,本文以洛克的财产理论为主线,试图阐释了政府、自由与财产之间的关系。本文认为,财产和自由相互依存,自由是财产的前提,财产是自由的保障。从“私有财产生圣不可侵犯”的观点出发,可以引出人类从自然状态向政治社会的转变,也就是由于自然状态的弊端,人类为了保存私有财产,从而建立起了政府。而在此基础上建立起的政府,在面对私有财产权时,如何处理好公共利益和私人权利时,总是让人头伤。
Freedom and property are two core propositions that Locke follows. Based on Locke’s theory of property, this article tries to explain the relationship between government, freedom and property. This article argues that property and freedom are interdependent and that freedom is the precondition of property and property is the guarantee of freedom. From the perspective of “inviolability of private property”, it leads to the transformation of mankind from the natural state to the political society, that is, due to the defects of the natural state, human beings have established a government in order to preserve their private property. However, the government established on this basis always gives headaches when dealing with the public interest and private rights in the face of private property rights.
