现有的WTO协议中已有一些初步的竞争规则 ,但还没有形成一个单独的有关国际竞争法的协议。本文从贸易与竞争的互动关系审视了在WTO框架下建立国际竞争规则的可能性与必然性 ,作者归纳、分析了近年来国际社会对这一敏感问题的讨论 ,认为拟议中的WTO竞争规则应包括国民待遇、最惠国待遇和透明度原则 ;应规定合作打击影响国际贸易的限制竞争行为 ,尤其是核心卡特尔 ;应有效建立竞争执法的国际合作机制
There are already some preliminary competition rules in the existing WTO agreements, but no separate agreement on international competition laws has yet been formed. This article examines the possibility and necessity of establishing international competition rules under the framework of WTO from the interactive relationship between trade and competition. The author summarizes and analyzes the international community’s discussion on this sensitive issue in recent years, and argues that the proposed WTO competition rules should include National treatment, most-favored-nation treatment and transparency; cooperation in combating restrictive practices affecting international trade, in particular core cartels, and international cooperation mechanisms for competition law enforcement should be effectively established
