高等院校教育法律纠纷是指学校在教学活动过程中,学校、教师和学生三方面主体权益的矛盾冲突,以教育权利为基本核心,涉及到财产权、人身权和民主权等方面。现代教师与学生开始运用法律武器来维护自身的权利。应建立健全教育行政复议制度,完善教育申诉制度,构建教育仲裁制度保护学生和教师在高校中的合法权益。
Legal disputes in higher education refer to the contradictions and conflicts of rights and interests of the school, teachers and students in the process of teaching activities. The educational rights as the basic core involve the aspects of property rights, personal rights and democratic rights. Modern teachers and students are beginning to use legal weapons to defend their rights. The system of administrative reconsideration of education should be established and perfected, the education appeal system should be perfected, and the educational arbitration system should be established to protect the legitimate rights and interests of students and teachers in colleges and universities.
