《商品房预售许可证》的审查与颁发,体现了政府对商品房预售制度事前监管。由于近年来政府监管所产生实际效果与预期有着很大的差别,关于行政许可制度存在必要性引发了强烈的争议。而我们应当在肯定商品房预售许可制度存在必要性的同时,通过严格宪政控制、具体法律约束等手段,使其在社会生活中的积极效应最大化。
The review and issuance of the Permit for Pre-sale of Commercial Housing reflects the government’s prior supervision over the pre-sale system of commercial housing. Due to the great difference between the actual effect of government regulation and the expectation in recent years, there is a strong controversy over the necessity of the administrative licensing system. And we should affirm the necessity of pre-sale permit system for commercial housing, and at the same time maximize the positive effects in social life through strict constitutional control and specific legal restrictions.
